California’s Draft Cannabis Legislation

The California Department of Food and Agriculture (CDFA) has released proposed regulations to establish cannabis cultivation and licensing policies within the state of California.

Under the Medical Cannabis Cultivation Program, established by the Medical Cannabis Regulation and Safety Act in 2016, CalCannabis Cultivation Licensing is responsible for developing regulations to license commercial cultivators of cannabis for medical use. The regulations establish requirements for the cultivation, manufacture, distribution, transportation, lab testing, and sale of medical cannabis.

The regulations expand the regulatory authority of various licensing entities in California including:

  • Bureau of Medical Cannabis Regulation (BMCR) - A branch of the Department of Consumer Affairs, responsible for licensing transporters, distributors, testing labs, dispensaries, and microbusinesses.
  • CalCannabis Cultivation Licensing - A division within the Department of Food and Agriculture that provides licenses to cannabis cultivators. It also oversees the implementation of a track-and-trace system that records the movement of cannabis throughout the distribution chain.
  • Office of Medical Cannabis Safety (OMCS) - Housed within the Department of Public Health, OMCS is responsible for overseeing manufacturers of cannabis products.
