Similar product labeling and legislature to Proposition 65 may be coming to New York

On January 15, 2019, Governor Andrew M Cuomo announced that a proposal for “informed consent” regulations was under review in the new Executive Budget. The proposal is aimed at protecting citizens from health risks resulting from potential exposure to hazardous chemicals. If “potential exposure” is sounding very similar to California’s Proposition 65, that is because the proposed legislature would be handled in a similar manner including warning labels and a list of 1000+ carcinogens; companies would also have to examine and analyze the composition of their products and identify any hazardous substances within their products being sold in and/or shipped to the state of New York.

Common chemicals that this proposal could potentially include are:
  • Lead and lead compounds
  • Bisphenol A (BPA)
  • Phthalates
  • Wood dust
  • Crystalline silica (respirable size)
