The state regulation of products is a constantly changing landscape. Compliance depends upon keeping abreast of all of these changes as soon as they happen and non-compliance is not only costly but can hurt a company’s reputation. These changes affect all kinds of products, including pesticides, fertilizers, soil and plant amendments, biostimulants, animal feed and pet food. All of these products are subject to year-end registration and license renewals in many states and it is not too early to start preparing for the inevitable paperwork burden programs like this bring.

  • Implementation of a new system to California’s Department of Pesticide Regulation NOD (Notice of Decision) Process, potentially causing increases in product review times
  • New York recently enacted legislation that prohibits the sale and distribution of household cleaning products and personal cosmetic products that contain 1,4-dioxane in greater than trace amounts
  • South Dakota has switched from a two-year registration cycle to a single-year cycle
  • Kansas has moved to a state-hosted online portal for fertilizer registrations and renewals. Registration costs have also increased to US$45 per product
  • Massachusetts has launched a new online portal for pesticide registrations which has triggered a defacto re-registration of all products registered in the State (new portal requires the submission of all product files and information; not typically required for product renewals)
  • Missouri Fertilizer Control Board has launched a new web portal and is no longer accepting paper renewal submissions
  • Virginia has increased its pesticide registration fees from US$160 to US$225, as of July 11, 2019

  • Enforcement of California’s SB-258 (Cleaning Product Right to Know Act of 2017) begins January 1, 2020
  • CA Legislature is considering SB-574, the ‘Cosmetic Fragrance and Flavor Ingredient Right to know Act of 2019’ and has an anticipated commencement (following enactment) of July 1, 2020
  • The California Air Resources Board is currently in the process of revising its rules and definitions for VOCs (Volatile Organic Compounds) in Consumer Products
  • California’s DTSC (Department of Toxic Substance Control) is holding a workshop on August 21, 2019 covering 1,4-dioxane in consumer personal care and cleaning products
  • New York’s Ingredient Disclosure Program enforcement is postponed until January 1, 2020
  • New York legislature is considering a measure that would prohibit the sale and distribution of glyphosate and products containing glyphosate
  • Idaho is developing a new online portal for pesticide registrations and renewals
  • Tennessee is developing a new online renewal system for pesticide registration. The state has also issued new renewal forms for both fertilizer and feed registrations
