Regulatory guidance
Europe
Regulation (EC) 1223/2009 dictates the ingredient restrictions and labelling requirements, as well as the safety standards cosmetic products must fulfil before being placed on the EU market. The regulation impacts manufacturers, distributors, retailers, packers, contract manufacturers and importers.
USA
In the US, cosmetic products and ingredients are regulated under the Federal Food, Drug and Cosmetic Act (FD&C Act) and the Fair Packaging and Labeling Act (FPLA). In addition to FDA, cosmetics and personal care products are subject to state regulations, particularly the State of California’s Proposition 65.
Canada
The Cosmetic Regulations of the Food and Drugs Act require that cosmetics sold in Canada be manufactured, prepared, preserved, packed and stored under sanitary conditions. In addition, manufacturers must notify Health Canada that they are selling the product and provide a list of its ingredients.
